Following the publication of Decree no. 2018-997 in the Journal Officiel de la République, RTE is consulting the draft of the new rules of the French capacity mechanism.

Decree no. 2018-997 of November 15, 2018 on the capacity obligation mechanism in the electricity sector was published in the Journal Officiel de la République Française on Saturday, November 17, 2018.

Following this publication, RTE is starting a consultation process for a rules project on the Concerte website. In accordance with article 3.2.1 of the rules in force, stakeholders are invited to send their comments exclusively on Concerte from Monday the 19th of November to Friday the 30th of November. For the timely approval of the capacity mechanism rules by the end of 2018, feedback sent after the consultation’s closing date cannot be taken into account.

The document subject to this consultation incorporates all the provisions provided for in the European Commission’s approval decision of November 8, 2016 into the capacity mechanism rules and thus finalises the work related to the compliance of the French capacity mechanism with the internal electricity market.

The changes made to the rules are based on the dialogue process conducted in 2018, the summary of which was presented to stakeholders during the Capacity Mechanism WG of October 19, 2018 and is available on Concerte. In particular, the following elements have been modified:

  • the procedures for explicitly taking into account the contribution of interconnections have been introduced in the Certification section and in the “Participation of Interconnection Capacities in the French Capacity Mechanism” segment (Article 9);

  • the procedures for the organisation of the long-term call for tenders for new capacities were introduced in the “Long-Term Call for Tenders” (Article 10);

  • the capacity mechanism parameters have been updated based on simulations from the 2018 Provisional Long Term Forecast Plan;

  • the calculation sections of the Rules have been moved to the appendices to improve the Rules’ readability.

In addition, RTE will be communicating this week on how to put crossborder capacity guarantees on the market for the 2019 delivery year.
